HORSEBACK RIDING/ TRAINING RELEASE FORM AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

In consideration for allowing me ( or my minor child/children ) to handle and rise a horse(s) and on behalf of myself, my child, or our personal representatives, heirs, next of kin, spouses, and assigns, I:

  • Acknowledge that an equine may, without any warning or any apparent cause, buck, stumble, fall, rear, bite, kick, run, make unpredictable movements, spook, jump obstacles, step on a person's feet, push or shove a person, saddles or bridles may loosen or break - all of which may cause the rider to fall or be jolted resulting in serious injury or death to the Undersigned or any person within close proximity of a horse.

  • ACKNOWLEDGE THAT HORSEBACK RIDING, THE HANDLING OF A HORSE OR BEING IN CLOSE PROXIMITY TO A HORSE IS AN INHERENTLY DANGEROUS ACTIVITY AND INVOLVES RISKS THAT MAY CAUSE SERIOUS INJURY AND IN SOME CASES DEATH because of the unpredictable nature and irrational behaviour of horses, regardless of their training or past performance.

  • Voluntarily assume the risk and danger of injury or death inherent in the handling or riding of a horse or being in close proximity to a horse or on the premises of the stables or the failure
to wear a protective helmet when riding a horse, and use of saddles, bridles, equipment and gear provided by Benua Equestrian Stables (BEST).

  • RELEASE, DISCHARGE AND PROMISE NOT TO SUE Benua Equestrian Stables (BEST) for any loses, damage, injury (including death) or costs to me or my child/children arising from the handling or riding of a horse being in close proximity to a horse or on the premises of the stable or the failure to wear protective helmet when riding a horse, and use of saddles, bridles, equipment i and gear provided by Benua Equestrian Stables (BEST).

  • Release Benua Equestrian Stables (BEST) from any claim of negligence in connection with me or my child/children's riding a horse, including but not limited to training or selection horses) maintenance, care, fit or adjustment of tack, instructor on riding skills or leading and supervising, riders or the use of any equipment provided by Benua Equestrian Stables (BEST) which resulted in loss, damage, injury of death.

  • INDEMNIFY AND SAVE AND HOLD HARMLESS Benua Equestrian Stables (BEST) from and against any loss, lability, damage or lost they may incur arising out of or in any way connected with either me or my child/children's handling or riding the horse or being near a horse while under the instruction of care of Benua Equestrian Stables (BEST).

  • Agree that have read and understand that all equine professionals including grooms, staff and anybody involved in any equine activities are not liable for an injury to and the death of a participant in equine activities resulting from the inherent tasks of equine activities.

  • Agree that the foregoing release and waiver of liability, assumption of risk and indemnity agreement is covered by Malaysian laws and is intended to be as broad and inclusive as is permitted by Malaysian law and that in the event any portion of this Agreement is determined to be invalid, illegal or unenforceable for any reason, the balance of the Agreement shall not be affected or impaired in any way and shall continue in full legal force and effect.

  • Acknowledge that this is a contract and agree that if a lawsuit is filed against Benua Equestrian Stables (BEST) for any injury, death, loss or damage, I will pay all attorneys fees and costs incurred by Benua Equestrian Stables best in defending such an action.

  • Understand and agree that I am entering the premises at my own risk and agree to hold any persons) responsible for any accident, injury or death occurring to my animal, myself, my guests or my personal property as a result of occupying the said premises.

  • ALL RIDERS ARE REQUIRED TO WEAR A PROTECTIVE HELMET. IT IS MY UNDERSTANDING THAT SAID HELMET IS NOT GUARANTEED TO BE EFFECTIVE AND MAY FAIL IN THE EVENT OF AN ACCIDENT. ALL RIDERS ARE REQUIRED TO PURCHASE THEIR OWN APPROVED HORSEBACK RIDING HELMET.

  • Allow my child/children's picture and/or video to be taken and published to Benua Equestrian Stables (BEST) Facebook page and/or any social media platforms, provided no names or personal information given.

  • Agree to pay or reimburse BEST in the event of injury to the said horse(s) whilst I was handling or riding it.

  • In the event of any injuries to the horse whilst your riding, the vet bills will be borne by you.

  • Cancellations/bookings must be notified 24 hours PRIOR otherwise class will be forfeited.

  • Late Arrival Results in shorter sessions.

  • No refund policy.

  • Management reserves the rights to change/ alter terms and conditions without any prior notice.

  • Dress smartly - We can deny you riding due to improper/indecent attire.

  • Ride at your own risks. We are not responsible for any injury, death, loss or property damage to property.
